- When your order is placed we will e-mail you a confirmation of your order, this is to confirm we have received your order and is not an indication of a contract between us.
- When we have accepted your order we will send you an acceptance e-mail indicating the commencement of a contract between us.
- For purchases of products containing alcohol the purchaser must be 18 years of age or older. If we reasonably suspect the purchaser to be below this age we reserve the right to cancel the order and issue a refund to the card details provided.
Price and description of goods - The price and description of goods is as shown on the Online Store at the time of your order being placed.
- If we discover, within 7 days of the acceptance of your order, that the goods, as described at that time, are unavailable we may terminate the contract and credit or refund you within 7 working days for any amount that has been paid by you.
- If we discover, within 7 days of the acceptance of your order, that some but not all of the goods are available then the unavailable goods will no longer be supplied. In this case we will contact you to offer the option of amending, or cancelling entirely, your order. Alternatively we may provide substitute goods of a similar nature and value. If at the time we discover any goods to be unavailable you have already paid for, or your credit/debit card has been charged, we will, within 7 working days, refund you. In the case of an amended order this refund will be for the difference between the original order or in the case of your entire order being cancelled we will refund the entire amount.
- Every effort will be made to maintain accurate prices on the website, however in the event of an incorrect pricing we will contact you before accepting your order, and commencing the contract between us, in order to confirm that the correct price is acceptable.
- In addition to the listed price of the goods you may also be required to pay a delivery charge which will be clearly detailed during the ordering and payment process.
- The images of the products provided are for illustrative purposes only, and may differ from the actual products, this may be as a result of the display of the image on your computer or as a result of a change in packaging by the manufacturer. In the case of a change in packaging we will make every attempt to update the provided image as soon as possible, but cannot guarantee the image displayed at the time of ordering will match the product received.
Payment - Payment for the total order value, including goods and delivery, shall be made by you at the time of placing the order, by any method shown on the website.
- Delivery will not take place until full payment has been received and cleared, with the exception of business orders where we have a credit agreement with you.
- Payment must be made in full, and with no deduction, unless you have a valid court order requiring the amount of such a deduction be paid to you by us.
Substitution of goods - All goods are subject to availability, in the event that goods you have ordered are not available we may substitute them for similar goods of the same or greater value.
- Should we need to substitute goods we will contact you to confirm that the substitutions are acceptable, if they are not you may opt to proceed with the order without the unavailable goods, to select your own alternatives or to cancel the order entirely. Should you choose alternative goods of a greater or lesser value, we may refund or charge you the difference as appropriate.
Delivery - The goods ordered shall be delivered to the address provided by you when the order is placed, whether this be your personal address or another address provided by you.
- If delivery cannot be made to the destination address for reason under our control, we will inform you as soon as possible.
- If you intentionally refuse delivery, for reasons other than those of damaged goods or valid order cancellation, we may store the goods until such time as delivery can be successfully made, and charge you for any costs incurred for storage and/or re-delivery.
- If you fail to take delivery because of a valid cancellation, we shall refund you within 14 working days of receiving the returned goods. In the event of a cancellation you will be required to return the goods, and a refund will not be issued until the goods are returned to us in full. If you fail to return the goods we reserve the right to charge, or deduct from your refund, any costs incurred from this failure.
- While we will make every effort to successfully deliver your order, as soon as possible, after your order is accepted, we will not be liable for any damage or loss incurred by you due to reasonable or unavoidable delay. In the case of such delay we will inform you as soon as possible.
- When you receive your order you will be required by the courier to sign for receipt of the delivery. If the package appears to be damaged or in poor condition you should refuse the delivery. If you are unable to inspect the contents of the package at the time of receipt you should sign the parcel and mark it 'Unchecked', failure to do this my affect any insurance/warranty claims.
- Deliveries are subject to our Delivery Policy which can be found under 'Frequently Asked Questions'.
Ownership/risk of goods - Ownership of the goods passes to you at, and not until, we have received full and cleared payments for the full value of the order including delivery.
- The goods will be at your risk from the point of delivery, i.e. When the package has arrived with you and has been signed for.
Cancellations and returns - In order to make a cancellation, written notice must be provided to us in the form of either letter or e-mail to the contact addresses provided in the 'Contact Us' section of the website.
- Under the Distance Selling Regulations you may cancel your order within 7 days of receipt, providing the goods are returned to us in their original condition returned to us. This does not apply to fresh food items due to their perishable nature, these may only be returned in the case of damage or fault with the goods. In the case of returning goods due to wishing to cancel the order, the cost of returning the items lies with the customer, with the exception of goods which were provided as a subsitute for an unavailable product.
- Should you wish to cancel or otherwise return your order you must contact us first to arrange this either by phone or e-mail, which are provided on the 'Contact Us' section.
- You may cancel your order without charge at any point before we e-mail you acceptance of your order, as no contract exists at this stage. Should you wish to cancel your order after it has been accepted and/or dispatched for delivery then we reserve the right to charge, or deduct from your refund, any reasonable handling or re-stocking cost incurred by us.
- Cancellations after the point of our acceptance of your order, and thus the commencement of a contract between, are subject to our mutual agreement upon the cancellation.
- If the goods are damaged in transit, or upon delivery are found to be incorrect or faulty, you must notify us of this within 7 days of receipt of the goods, at which point we will request your return the goods to us. Upon receiving the returned goods and our inspection of them, we will contact you to arrange, at our mutual agreement, either replacement goods or a refund of the value of the returned goods and, at our discretion, your return postage costs.
Limitation of Liability - We shall not be liable for any loss or damage suffered by you in cases where:
i. Any loss or damage is not reasonably foreseeable by us and is not a result of negligence, misrepresentation, or breach of legal duty by us. ii. Losses incurred by you are not as the result of, or increased by, any breach of these terms on your part. - In the case of business purchases we also shall not liable, in the circumstances detailed above, for any loss of business, profit, revenue or goodwill incurred either directly or indirectly by you.
